Bankruptcy is a system of federal laws that are designed to eliminate all or most debt, in order to give the debtor a fresh financial start. In a Chapter 7 bankruptcy, most unsecured debts (such as credit cards and medical bills) are eliminated. Notable exceptions include student loans, majority of taxes, child support. These debts are not affected by Chapter 7 bankruptcy.
For their secured debts (such as the amount owed on a car or a house), debtors filing bankruptcy can generally choose to either give back the collateral and wipe out the debt, or keep the collateral and continue paying for it by negotiating and entering into reaffirmation agreement and having it approved by the Court.
Bankruptcy can be a confusing process for many people, and changes in the bankruptcy laws only make it more difficult to understand. Don’t make a decision until you educate yourself about the options available to you.
